The main risks fall into four areas. First, legal exposure under UK GDPR Article 22, which gives candidates the right not to be subject to decisions based solely on automated processing with significant effects.
Second, bias amplification - AI models trained on historical data can reproduce and scale existing discrimination, creating indirect discrimination risk under the Equality Act 2010.
Third, lack of explainability - if your AI can't tell a candidate exactly why they scored as they did, you can't meet your transparency obligations.
Fourth, ineffectiveness against AI-generated applications, where candidates use tools like ChatGPT to produce polished responses that other AI systems score highly. The risks are highest with 'black box' AI scoring tools that read free-text CVs or personal statements. A robust AI recruitment policy should cover six areas.
Scope - which AI tools are permitted, which are prohibited and which require sign-off.
Governance - who owns AI decisions, how DPIAs are completed and how suppliers are vetted.
Transparency - how you tell candidates AI is used and what it does.
Human oversight - the explicit rule that no AI tool makes the final hiring or rejection decision.
Fairness and bias monitoring - how you track outcomes across protected groups under the Equality Act 2010.
Contestability - the process candidates can use to query or challenge AI-influenced outcomes.

UK GDPR Article 22 gives individuals the right not to be subject to decisions based solely on automated processing - including profiling - that produces legal or similarly significant effects. Recruitment decisions count as significant effects. In practice, this means three things for AI in hiring.
First, if AI materially determines whether a candidate progresses, meaningful human oversight must exist at every decision point. Second, candidates have the right to an explanation of how automated processing affected them, which you can only provide if your AI's logic is genuinely explainable. Third, candidates must have a route to contest outcomes.

Candidate transparency about AI is increasingly both a legal requirement under UK GDPR and an employer brand issue. A good AI transparency notice covers five things, in plain English.
Confirm AI tools are used in your recruitment process, and briefly describe what each does - for example, generating assessment questions, matching talent pools, or automating communications.
Confirm that no AI tool makes a final hiring or rejection decision and that all decisions involve human review.
Explain how candidate scoring works, including whether it's based on transparent, pre-set criteria.
Set out what personal data is processed and how candidates can access, correct or delete it.
Give candidates a clear route to ask questions or contest outcomes. Publish the notice on your careers site, link to it from your privacy policy, and reference it in your application confirmation emails.
